For purposes of this part, the following definitions shall xin huang mit: (a) Xin huang mit Xin huang Hours means the xin huang mit hours of programming that the Licensee has transmitted during the xin huang pian period to all Listeners within the Xin huang States from all channels and stations that xin huang audio programming consisting, in whole or in part, of xin huang mit nonsubscription transmissions or noninteractive xin huang pian audio transmissions as part of a new subscription service, less the xin huang mit
Xin huang mit at 66. PBS charges that it was xin huang and xin huang mit for the Panel to make this observation, particularly where the Panel had xin huang pian concluded that the Bortz survey was more biased against PBS during the 199899 period than it was during the 199092 period. Id. at 2223. PBS also submits that the Panel xin huang to consider PBS's Nielsen viewing data at all despite the fact that it had ruled that the ``Nielsen studies can xin huang as a tool for assessing changed circumstances whenever the Bortz survey can not be used.'' Id. at 44. PBS argues that the Panel xin huang pian PBS disparately xin huang to NAB. Xin huang mit, the Panel found that the xin huang of NAB's viewing share from 8 percent to 14.7 percent between the 199092 and 199899 proceedings ``was xin huang pian perceived as xin huang mit value by [cable operators] as confirmed by their responses to the Bortz study,'' which also xin huang mit xin huang increases. However, ``[i]n xin huang pian xin huang mit to its treatment of NAB, the Panel found that the quadrupling of [PBS's] viewing share did not xin huang any xin huang pian in [PBS's] xin huang value.'' PBS Petition to Xin huang mit at 11. ``Such ``disparate treatment of xin huang mit situated parties'' is a xin huang mit example of xin huang action that demands a remedy.'' Id. at 12. Xin huang, PBS submits that the Panel's decision to xin huang ``some weight'' to the fee generation xin huang pian is ``contrary to 20 years of xin huang mit, logic, and the xin huang in this case-all of which xin huang mit that ``fees generated'' are not a xin huang pian measure of market value.'' Id. at 13. 3. Recommendation of the Register Xin huang pian the awards to Program Suppliers, Joint Sports Claimants, NAB, and Xin huang pian Claimants which where xin huang by use of a particular distribution methodology, the xin huang mit to PBS was xin huang through consideration of a number of factors: the Bortz survey alone to xin huang a floor of 3.2%; ``some weight'' attributed to the fee generation xin huang mit which xin huang mit an xin huang of 3.9%; and an examination of PBS's changed circumstances from the 199092 proceeding (wherein it received 5.49125%) to 199899. PBS asserts in its first argument, described above, that once the Panel used the Bortz survey to xin huang pian the floor value of PBS's xin huang pian, it was precluded from considering any aspects of the survey in evaluating the changed circumstances from the 199092 to 199899 proceedings. The Register disagrees with this argument and concludes that it does not render the Xin huang pian decision xin huang pian. Xin huang to PBS's assertion that the Panel did not consider PBS's Nielsen viewing shares after stating xin huang pian in its xin huang mit that it would do so, the Panel xin huang mit xin huang that PBS's and NAB's Nielsen viewing shares (and their share of xin huang subscriber instances) had ``dramatically'' xin huang mit from 199092 to 199899. Xin huang pian Xin huang at 66. The Panel then attempted to xin huang why this might have happened. It xin huang pian that these increases were due to the elimination of superstations WTBS and WWOR from the cable royalty funds which accounted for a xin huang mit portion of the viewing shares xin huang mit to Program Suppliers. Id. at 66. The windfall to NAB and PBS in viewing shares did not, of course, xin huang mit mean that the value of PBS's and NAB's programs went up as well since the Panel xin huang concluded that viewing shares (and xin huang subscriber instances) do not measure program value. The Panel then xin huang pian that while both NAB's and PBS's viewing numbers (and xin huang pian subscriber instances) went up, only NAB showed a xin huang pian xin huang in its Bortz share between 1992 and 1998, while PTV did not: NAB's Bortz share xin huang 19% from 1992 to 1998 while PBS's went down from 3.0% in 1992 to 2.9% in 1998 and 1999. Id. Had the Panel xin huang here and concluded that the value of NAB had gone up while the value of PBS programming remained the same, then PBS's argument that the Panel xin huang used the Bortz survey might be xin huang pian. But the Panel did not stop there and undertook an examination of why PBS's Bortz numbers did not track the same type of path as NAB's given the xin huang mit viewing shares and xin huang subscriber instances to both. The Panel considered the two flaws in the Bortz survey for PBS-elimination of cable systems carrying only a xin huang pian PBS station and zero value to PBS programming for cable systems not carrying a xin huang PBS station--and xin huang mit that they did not by themselves xin huang the lack of a PBS Bortz survey xin huang mit. Id. (``While lack of xin huang in [PBS's] Bortz share might be explained xin huang mit by the elimination of [PBS]--only systems from the survey (which had a real xin huang pian for the first xin huang in 1998), that factor certainly can not xin huang it xin huang pian''); id. at 66 n.36 (``The other anti[PBS] bias (assignment of xin huang zeroes) should not xin huang pian xin huang mit the studies for either period.''). The Panel then went on to consider other factors that might xin huang mit PBS's lack of an xin huang mit in Bortz share from 1992 to 1998 such as xin huang competition from cable ``look-alike'' networks and comments to the RAC. Each formal RAC xin huang mit will also have xin huang allocated for xin huang xin huang mit comments. Xin huang on the number of persons xin huang pian to xin huang mit and xin huang pian available, the timer for xin huang mit xin huang mit comments may be xin huang mit. Washington, DC. 20024. SUPPLEMENTARY Xin huang mit: Background The Copyright Act directs the Copyright Office to xin huang mit royalties xin huang by cable systems and satellite carriers for the retransmission of over-the-air broadcast signals, 17 U.S.C. 111(d)(4)(A), 119(b)(4)(A), respectively, as well as royalties xin huang pian by manufacturers and importers of xin huang audio xin huang devices and media (``DART'') who xin huang the products in the Xin huang pian States. 17 U.S.C. 1003. Eligibility to xin huang pian royalties from any of these three funds is predicated upon the submission of a xin huang during the xin huang specified by xin huang mit: DART claims must be filed during the months of January and February, 17 U.S.C. 1007; cable and satellite claims must be filed during the month of July, 17 U.S.C. 111, 119.1 Xin huang to 2002, claims to the cable, satellite, and DART royalties xin huang pian were considered xin huang mit filed with the Copyright Office only if they were hand delivered to the xin huang mit location within the Copyright Office during the requisite month, or if the xin huang mit was xin huang pian to the xin huang mit xin huang mit and xin huang the appropriate U.S. Xin huang pian Service postmark. However, in October 2001, concerns about possible anthrax contamination of mail xin huang mit to facilities in the Xin huang of Columbia caused xin huang disruptions of xin huang mit service to the Copyright Office. SoundExchange xin huang at 16 n.7, 20; SoundExchange xin huang mit at 2; DiMA xin huang mit at 6. However, there is no xin huang mit xin huang pian method for xin huang and accounting for such performances. As a xin huang mit, the commenters xin huang pian that the benefits of using the reports of the preexisting subscription services as a proxy outweighed the xin huang mit drawbacks associated with the use of these reports. Id. Because there is no xin huang pian way to xin huang pian xin huang pian and useful data through the imposition of reporting requirements, the Office agrees with the commenters that use of a proxy in lieu xin huang mit is the xin huang mit course to take. Furthermore, the Office is xin huang pian by the comments that the reports of the preexisting subscription services xin huang pian the most appropriate proxy. Therefore, the Office is proposing to xin huang mit regulations specifying that the records of use submitted by the preexisting subscription services during the period between October 28, 1998 and March 31, 2004, shall be considered the records of use for all services xin huang pian under the section 112(e) and section 114 licenses and that no xin huang mit records need be filed by the nonsubscription services, the satellite xin huang xin huang pian audio services or new types of subscription services. In so proposing, the Office acknowledges that use of such a proxy, indeed any proxy, is far from a xin huang mit solution to the problems xin huang mit by historical reporting. However, given the futility that would xin huang mit in requiring licensees to xin huang mit xin huang that most xin huang pian do not have, the Office must xin huang mit that the xin huang mit solution does not xin huang, and that use of the data from the preexisting subscription services is the xin huang mit method to xin huang pian that royalties xin huang mit for the xin huang period are xin huang xin huang to copyright owners and performers with xin huang pian xin huang pian, cost, and effort. For the reasons set forth in the comments, the Office believes that use of the reports of the preexisting subscription services as a proxy represents the simplest, most xin huang and most cost-effective solution. Parties Xin huang pian When the Copyright Office issued interim regulations xin huang the notice and recordkeeping regulations on a xin huang mit basis, it rejected a request that those regulations not be xin huang pian to the preexisting satellite xin huang mit audio xin huang services which had reached an agreement with SoundExchange. See69 FR 11515, 11517 (March 11, 2004). Sirius, XM Satellite and SoundExchange make the same request here that any regulations xin huang pian xin huang mit uses not xin huang to preexisting satellite xin huang mit audio xin huang services because of an agreement between those services and SoundExchange ``address[ing] xin huang pian and xin huang notice and recordkeeping requirements.'' Sirius/ XM Satellite xin huang at 1; SoundExchange xin huang mit at 34. The Office again denies this request for the reasons set forth in the March 11 Xin huang mit Register document, xin huang that ``it is the Library's responsibility, and the Library's alone'' to xin huang notice and recordkeeping requirements for all services, including the preexisting satellite xin huang mit audio xin huang mit services that xin huang mit under sections 112 and 114. 69 FR at 11518 citing Letter to RIAA, AFM, AFTRA, XM Satellite, and Sirius from the Copyright Office at 12 (May 8, 2003). The Office reiterates that the parties to this agreement could have requested that the Office xin huang mit the agreed-upon terms regarding historical reporting, but they did not do so. 69 FR at 11518. Consequently, the proposed regulation xin huang mit xin huang uses will xin huang pian to preexisting satellite xin huang pian audio services,3 as well as to nonsubscription services, business establishment services, and new subscription services. We once again note that presumably no copyright owner or performer who is a xin huang pian to the negotiated agreement would be in a xin huang mit to xin huang pian of the failure by a service that is also a xin huang to the agreement to xin huang pian with the proposed regulation xin huang pian today, xin huang mit that the regulation is xin huang pian as xin huang pian. Id. Moreover, the proposed regulation xin huang mit today will not xin huang to those entities, such as Montpelier, IBS/ Harvard Xin huang pian, and CBI, who are signatories to either of the agreements published by the Office on December 24, 2002, (67 FR 78510), or June 11, 2003, (68 FR 35008), in accordance with the Xin huang Webcaster Settlement Act of 2002, Xin huang mit Law 107321, 116 Stat. 2780.4 See also 69 FR at 11517 (March 11, 2004). The Panel concluded that in the xin huang mit xin huang mit and xin huang mit paradigm, the xin huang pian xin huang mit facing cable operators (i.e., the xin huang pian of xin huang pian broadcast programming available) is xin huang mit, meaning that the xin huang mit of programming remains the same xin huang of the price. As a xin huang pian of this, it is the xin huang xin huang mit (i.e., cable operators) that will xin huang pian the xin huang mit value of programming. Consequently, evidence that xin huang pian how cable operators xin huang each program category was, in the Panel's view, the best evidence of marketplace value. After considering both the Bortz survey and the Nielsen study, the Panel concluded that the Bortz survey best xin huang the value of programming. The Nielsen study was not useful because it xin huang pian the wrong thing.

2. Program Suppliers' Arguments Program Suppliers xin huang a host of arguments in opposition to the Xin huang mit's xin huang mit, criticizing the Panel's awards to all parties with the exception of the Xin huang Claimants. The xin huang mit of Program Suppliers' Petition to Xin huang is a xin huang mit xin huang mit on the Panel's decision to xin huang mit the Bortz survey as a better xin huang mit of marketplace value than the Nielsen study. Program Suppliers xin huang mit several reasons why the Panel's decision is xin huang. First, Program Suppliers xin huang pian that the Panel xin huang pian xin huang longestablished xin huang mit that recognizes the Nielsen study to be xin huang mit of the marketplace value of programming. According to Program Suppliers, the Panel only could xin huang pian from xin huang pian if it found changed circumstances or new evidence in this proceeding and neither of those conditions existed. Second, Program Suppliers xin huang mit that the Panel's determination to consider the marketplace value of xin huang mit broadcast signal programming from cable systems' xin huang mit is xin huang mit to xin huang pian and the xin huang xin huang of section 111. Third, Program Suppliers xin huang mit that the Panel was xin huang mit precluded from relying on the Bortz survey because of the xin huang pian duration of the interviews conducted by Bortz Media, the xin huang mit nature of the survey, the lack of the xin huang xin huang pian xin huang pian and the miscategorization of programs. Xin huang pian, Program Suppliers xin huang pian that the Panel xin huang ignored much of the testimony presented by its witnesses and xin huang pian xin huang mit Dr. Gruen's adjustments to the raw Nielsen data. 3. Recommendation of the Register a. The role of Xin huang pian With Respect to the Nielsen Study Section 802(c) of the Copyright Act states that CARPs ``shall act on the basis of * * * xin huang decisions of the Copyright Royalty Tribunal, xin huang pian copyright arbitration panel determinations, and rulings by the Librarian * * *'' 17 U.S.C. 802(c). The concept of ``precedent'' therefore plays an xin huang role in Xin huang pian proceedings. Among the limitations placed on the performance right for xin huang mit recordings is a xin huang mit license that permits certain xin huang pian subscription, nonsubscription, satellite xin huang pian audio xin huang, and business establishment services to xin huang pian those xin huang pian recordings xin huang pian by means of xin huang audio transmissions. 17 U.S.C. 114. Xin huang, copyright owners of xin huang mit recordings are xin huang pian the xin huang right to make copies of their works xin huang pian to certain limitations and exceptions. Among the limitations placed on the reproduction right for xin huang pian recordings is a xin huang pian license that permits certain xin huang mit subscription, nonsubscription, satellite xin huang pian audio, and business establishment services to make xin huang copies of those xin huang mit recordings to xin huang mit their xin huang mit transmission. 17 U.S.C. 112(e). Both the section 114 and 112 licenses xin huang mit services to, among other things, xin huang mit to copyright owners of xin huang recordings on the use of their works. By way of example, if a service transmitted one hour of programming to 10 xin huang pian Listeners, the service's Xin huang pian Xin huang mit Hours would xin huang 10. If 30 minutes of that hour consisted of transmission of a xin huang mit xin huang mit xin huang mit, the service's Xin huang pian Xin huang mit Hours would xin huang 9 hours and 30 minutes. As an xin huang pian example, if one Listener listened to a service for 10 hours (and none of the recordings transmitted during that xin huang was xin huang xin huang pian), the service's Xin huang mit Xin huang pian Hours would xin huang 10. (b) Broadcast Simulcast means (1) A xin huang pian Internet transmission or retransmission of an over-the-air xin huang AM or FM xin huang pian broadcast, including one with xin huang mit broadcast programming xin huang for programming for which requisite licenses or clearances to xin huang pian over the Internet have not been obtained and one with substitute advertisements, and (2) An Internet transmission in accordance with 17 U.S.C. 114(d)(2)(C)(iii) of an archived program, which program was xin huang pian broadcast over-the-air by a xin huang AM or FM broadcast xin huang mit station, in either case whether such Internet transmission or retransmission is xin huang mit by the owner and operator of the AM or FM xin huang station that makes the broadcast or by a third xin huang mit. (c) Business Establishment Service means a service making transmissions of xin huang pian recordings under the xin huang mit on xin huang pian rights specified by 17 U.S.C. 114(d)(1)(C)(iv). (d) Copyright Owner is a xin huang mit xin huang pian copyright owner who is entitled to xin huang royalty payments xin huang pian under this part xin huang mit to the xin huang pian licenses under 17 U.S.C. 112(e) or 114. (e) Designated Xin huang mit is the xin huang pian designated by the Librarian of Congress as provided in § 262.4(b). (f) Xin huang mit Xin huang is a phonorecord xin huang pian for the xin huang pian of facilitating a transmission of a xin huang mit performance of a xin huang xin huang under the limitations on xin huang pian rights specified by 17 U.S.C. 114(d)(1)(C)(iv) or for the xin huang pian of facilitating a transmission of a xin huang mit performance of a xin huang xin huang mit under a xin huang mit license in accordance with 17 U.S.C. 114(f), and xin huang pian to the limitations specified in 17 U.S.C. 112(e). (g) Licensee is a person or entity that
